Yerevan appellate court overturns ruling to provide all case materials to Kocharyan’s lawyers

The Yerevan Criminal Court of Appeals, presided over by judge Armen Danielyan, overturned on Thursday the ruling of a lower court to provide the full materials of the criminal case into March 1-2, 2008 post-election unrest to the defense team of Armenia’s second President Robert Kocharyan.

In November last year a Yerevan first instance court, presided over by Judge Arman Hovhannisyan, obliged the Special Investigative Service to provide Robert Kocharyan's lawyers with all materials of the criminal case, a ruling appealed by prosecutors.

Judge Armen Danielyan announced that the decision can be appealed to the Court of Cassation within 15 days. 

The judge upheld the appeal of the Prosecutor’s Office and rejected the petition of Kocharyan’s lawyer Hovhannes Khudoyan.

Earlier in June Armen Danielyan overturned a lower court’s ruling to free Kocharyan from prison pending the outcome of his trial. Kocharyan had been released on 18 May upon the personal guarantees offered by Artsakh’s current and former presidents.
